Terms of Agreement
ASSUMPTION OF RISK
We understand and acknowledge that there are certain risks, dangers and hazards inherent in swimming and swimming-related activities. On behalf of ourselves, our children and all guests at our pool party, we hereby voluntarily and freely assume all risk of accident and injury that may result from our childrenÂ's participation in swimming lessons or our childrenÂ's and our guestsÂ' participation at our pool party.
WAIVER/RELEASE OF LIABILITY
We hereby waive, release and forever discharge Finally Swim, LLC, and all swim instructor(s) and lifeguard(s) referred to us by Finally Swim, LLC, and Margarete Hyer individually (the Â"Released PartiesÂ") and agree to indemnify, defend and hold harmless the Released Parties from and against any and all actions, suits, demands, claims, damages and causes of action brought by any guest or invitee at a pool party at which any of the Released Parties provides lifeguard services.
CANCELLATION POLICY
Missed appointments, without prior notice, may be rescheduled, but a refund will not be issued. Cancellations and rescheduling will be up to the discretion of the instructor with whom you have been assigned, particularly when a cancellation must be made due to inclement weather. Forty-eight hour notice is required for canceling pool parties. If inclement weather prohibits us from carrying out the service on both scheduled dates, you will receive a refund minus a $20 handling fee.
PHOTO RELEASE
___ I grant Finally Swim, LLC the permission to display my childÂ's/children's photos on the Finally Swim website.

BY SIGNING BELOW I ACKNOWLEDGE AND AGREE TO ALL TERMS AND CONDITIONS LISTED ABOVE.
